Consent to Act as Designated Partner
Due: Filed with incorporation, alongside FiLLiP
Form 9 is a short but mandatory piece of the incorporation paperwork: each individual proposed as a designated partner formally consents, in writing, to take on that role and its responsibilities.
It’s filed together with FiLLiP (the main incorporation form) — not separately — as part of the same online application at the time the LLP is registered.
Every LLP needs at least two designated partners, and at least one of them must be a resident of India. Each one submits their own signed Form 9.
The same requirement — a designated partner’s written consent — applies again later if a new designated partner is appointed after incorporation, at which point it accompanies Form 4 instead of FiLLiP.
